An employer who employs uninsured workers has the opportunity to reconcile with both the worker and the state. With the enactment of the bag law proposal in the Turkish Grand National Assembly, the employer who was dismissed after January 2019 while working without insurance or who hires his existing uninsured worker and makes his / her insurance entry will be freed from criminal liability. Employees who are hired by insuring will not be able to sue the employer for the period of uninsured employment.

With the enactment of the omnibus law proposal, whose negotiations continue at the General Assembly of the Turkish Grand National Assembly, the employment incentives expired this year will be extended, and new employment incentives specific to the pandemic period will come into effect. Employers who recruit additional workers during the pandemic period will benefit from extra incentives during the termination ban. Employers who provide additional employment to the existing number of workers will then benefit from general incentives.

AFFORDING EMPLOYER HIRING AN UNINSURED WORKER

Uninsured workers who were dismissed between January 1, 2019 and April 17, 2020, and employers who recruit workers who continue to be employed without insurance on the date the law came into force, will be given a daily premium of 44.15 TL. The monthly incentive amount will be 1.324 TL. The incentive will continue during the dismissal ban.

No retrospective debt will be charged and no penal sanctions will be imposed on employers who have started to employ employees who have been or are being employed without insurance.

Workers who are entered into insurance will be deemed to have waived their other rights, except for wage or salary related rights.

Normally, employers found to be employing uninsured workers are fined each month in the amount of the minimum wage. Unpaid premiums are collected with default interest. Incentives and supports benefited during the period when uninsured workers are employed are also taken back with interest.

INCENTIVE FOR THE EMPLOYER HIRING EMPLOYED WORKERS SINCE 2019

44.15 TL per day and 1.324 TL per month will be given incentives to their former employers who re-hire insured workers who were dismissed from January 1, 2019 to April 17, 2020. The incentive will continue throughout the layoff ban. If the employer has to take unpaid leave after taking these workers, this time, the workers will be given 39.24 TL daily and 1.177 TL cash wage support.

A ASSISTANCE OF 1,030 TL PER MONTH TO THE WORKER WHO CANNOT RETURN TO WORK

Workers who are unemployed between January 1, 2019 and April 17, 2020 will receive a monthly aid of 1,030 TL over 34.34 TL per day, if they are not recruited by their former employers within 30 days. The assistance that will continue during the dismissal ban will be given on a household basis. In order to benefit from this assistance, the condition that there is no person who benefits from short work or unemployment allowance, works under insurance or receives regular social assistance will be sought.
